The name, Robert Erle first mentioned in Aldborough parish records

 

Note

 

During the fourteenth century the towns of Wakefield and Ripon were the pre-eminent cloth makers in the county with Wakefield producing 173 cloths and Ripon 168 cloths in the 1395-6 Ulnagers Accounts. Could this Robert Erle have links with the Erle's in Wakefield located a short distance south on the Great North Road?

Richard Earle, Yeoman of Roecliffe, 1612 (WYAS, Leeds, Ref: RD/AP1/35/26)

In the name of God Amen the 25th day of May 1612, I Richard Earle of Roecliffe in the Countye of Yorke, Yeoman beinge of good and p'fect health and p'fect remembrance, laud and prayse to almightye god, do ordayne and make this my last will and testament in manner and forme followinge. First I comende my soule to the hands of almightye god my maker and redemer and my bodye to be buried in the church yarde of Aldbrough. Item, I give and bequeath to Willm. Kettlesing 26s. 8d. Item, I give and bequeath 13s. 4d. to be distributed amongst the poore of the p'ish at the discretion of my neighbours of Rocliffe. Item, I give and bequeath to my sonne Richard Earle 2 halfe sows of arable land to enter to spring as hay and then sowen with wheate and pease one of them upon Galegarthes the other upon the Brothes. Item, I give unto him one bade cowe charged to take to him at Michaelmas next. Item, I give to him, my son Richard halfe of all my goods moveable and immoveable after my death. The residue of all my goods un-bequeathed my debts payd and funerall expenses discharged I give and bequeath to Agnes my wife whom I make sole executrix of this my last Will and Testament hopinge that she will doe well and be good to my sonne Richard and my mynd is that she should soe be if thinkinge that it is a small gifte to gratulate his paynes and naturall care he ever hath had of me and my wife. In testimonie whereupon I, the said Richard Earle have left my marke recalling all former wills heretofore made whatsover.

In the name of god Amen the four and twentie day of November Anno dmi 1635, I John Earle of Minskippe sicke of bodie but of good p’fect remembrance praised be almightie god do ordaine and make this my last will and testament in manner and forme following. First I bequeath my soule into the hands of almightie god and our saviour Jesus Christ who is the maker and creator of all good things in whose name I trust in the lord my soule to be saved, and my bodie to be buried within the p’ish churchyeard of Aldbroughe. Firstly, I give and bequeath unto Thomas Earle my son the one halfe of five sheepe be they more or lesse which is betwixt my son Willm Earle my son and me. Item, I give and bequeath unto my son Richard Earle three children whom I is grandfather unto, that is to say Willm Earle, John Earle and Ann Earle every one of them 5s. Item, I give and bequeath unto John Earle the son of Francis Earle whom I is grandfather unto 5s. Item, I give and bequeath unto Catherine Kettlesing 5s. Item, I give and bequeath unto my son Thomas Earle my son one blacke whie she to be winter cared upon the farmhould. Item, I give and bequeath unto Willm Earle my son my best coupe with wheeles and all the furniture therewith belonging. Item, my mind and will is that John Earle my son shall have the some of fiftie pounds of good and lawful English monye in regard that the saied John my son shall have no more part nor portion out of the goods nor no part of the farm hould hereafter. Whereupon I the said John Earle the younger is agreed and contented with the same. Item, my mind and will is that John Earle my son shall have the occupation of one little house or barne next unto the townend until Martin Mass next and a place for his tentures. And if he have or do occuppie the saied house and barne any longer the said John Earle my son is contented to give or pay unto my executors the some of five shillings yearlie so long as he doth occuppie the same. Item, my mind and will that whereas Francis Earle my son is furthered with his portion I give and bequeath unto my son Francis Earle £4 for mending of his portion. Item, I give and bequeath unto John Earle my son one codlitt, one blankitt and one mattresse, one cod, one linen sheet, one codwar, one brasse pot, one candlesticke, one dubler, one bordcloth and one mattresse. Item, my mind and will is that Willm Earle my son shall have, hould and occupie the halfe of my farm hould with Ellin Earle my wife during the lease. If the said Ellin my wife do die before the lease be run, then the saied Willm Earle my son to have all the holt farmhould to him and his heires during the lease. Item, I give and unto Richard Earle my son £7 the which is in his owne hand if the saied Richard Earle will seale aquitance to the executors and if he will not seale aquitance then the saied some to be paied to the executors. The rest of my goods not geven, nor bequeathed – my debts paied and funeral expenses discharged I give and bequeath unto Ellin Earle my wife and Willm Earle my son whom I do ordaine and make my executors of this my last will and testament.

In the name of God amen the twentie five day of Januarie anno dmi. 1636, I Willm Earle of Minskippe sicke of bodie butt of good and p'fect remembrance praised be allmightie God, do ordaine and make this my last Will and Testament in manner and forme following. First I bequeath my soule unto the hands of almightie god my maker and redemer, and my bodie to be buried within the p'ish churchyard of Aldbroughe. First I give and bequeath unto Richard Earle three children £8 to be equallie divided amongst them the saied £8 to be paied within one yeare. And the saied some to be in the hands of John Earle my brother, and he to se it go forward to them. Then I give unto Francis Earle son £6 within one yeare next after my death. Item, I give and bequeath unto Richard Earle, my brother my best clooke and thirtie shillings which is in his owne hand. Item, I give unto Katherine Kettlesing 5s. In the name of God Amen the xxth day of September anno dm 1637. I, Henrie Earle of Rocliffe in the pish of Aldburghe being sicke in body, butt of sounde and pfect remembrance god's name be praised for it do hereby ordaine and make this my last will and testam’t in writinge, manner and forme followinge. First I give and bequeath my soule into the hands of almyghtie god, my maker and to Jesus Christ my redeemer by whose death and purpose I hope to be saved. And my body to be buried in the church, or churchyarde of Aldburghe att the discretion of my executor. Item, I give and bequeath unto Peter Earle my younger sone all my terme of yeres in and to one messuage and lands appertaining thereto belonging in Minskipp that I have off Thomas Tankard Esq. And all the corn and hay in the barn there. Item, I give and bequeathe unto the said Peter Earle, my sone, all my interest, title and terms of years which I have in and for all those lands nowe in my demise, late the lands of William Simpson deceased. Item, I give and bequeath unto Richard Earle and the said Peter Earle, my sons all my tymber and woodd and sawhorses fytt for husbandrie equally to be divided between them. Item, I give and bequeath and my will and mynde is that after the legacies before mentioned be plyed, my debts and funerall costs discharged, all the residue of my goods, catells and chattels (of whatt nature or kind then the same be) shall be equally divided between the said Richarde and Peter Earle, my sonns, provided always and my will and mynde is that if my said sone Richard Earle cannott, or may nott lawfully have and enjoy his full shaire and pportion of all my goods, cattells and chattels accordinge to my wyshes aforesaid, or be debarred, or denyed of the same by the said Peter Earle my sone, then my will and mynde is and I do give and bequeath unto my said sone Richard Earle (my legacies as before mentioned first discharged) all such share and pportion of my said goods as shall, or may belonge to the deeds parte by wayes or meanes heresaid and I make the said Richard Earle and Peter Earle my sons joint Executors of this my last will and testament, these beinge witnesses – Francis Warde, William Burnand, Nycholas Yates.

In the name of god amen where as nothing is more certain than death and nothing more certain than the hour and time and place where and when. I therefore John Earle of Minskip in the county of York, woollen miller, being sick of body but in good and perfect memory, praised be god, do make my last will and testament the second day of January in the year of our lord god one thousand six hundred and fifty seven in manner and form following: First I give and bequeath my soul unto almighty god my saviour whom I trust in Jesus Christ my only redeemer will estow? it at the hour when my body shall descent this transitory life and my body to be buried in the churchyard of Aldborough. Item, I give and bequeath unto Richard Earle my second son £? of current money of England to be paid within ten days after he has accomplished the age of one and twenty years. Item, I give and bequeath to my daughter Ellen Earle eight pounds of current money of England within ten days to be paid to her after she shall accomplish the age of one and twenty years. Item, I give and bequeath unto my son Richard Earle one loom and pound of ??? and two flayes being the best loom I have. Item, I give and bequeath unto my daughter Ellen Earle ten shillings. Item, I give and bequeath unto my wife Mary Earle and to my first son Peter Earle my effects from my whole farm equally to be divided betwixt them. Item, I give and bequeath unto my said wife and my said son all the rest of my goods and chattels moveable and immoveable my debts and funeral expenses being paid forth of them and also make my said wife and my said son my whole executors to this my last will and testament in witness whereof I have put to my hand and seal the day in years first above written. My mind and will is that if my son Richard should fortune to die before my daughter then his portion shall go to her and if she die then her portion shall go to him

The condition of this obligation is is such that if the within bounden Marye Earle doe well and truly administer all and singular the goods rights and credits which late were and did belong unto John Earle, her husband lait of Minskipp. Then so farr as the law shall bind her if also she do enter into the register
of Richmond a true and juste inventory of the goods of the said deceased and make a true and juste ? of the premises when she shall be thereunto lawfully called educatinge and bringinge up the natural and lawful children of the said deceased with all ? whatsoever duringe theire minoritie and payieinge them theire severalle prospective childes ? which are due unto them by the death of John Earl aforesaid, their father and enter into such further bond for performance of the ? as now required as shall be thought fit and do ? by the Comissary. IN THE NAME OF GOD AMEN - September the fourth and twentieth one thousand six hundred fifty seaven. I, Peter Earle of Aldburgh in the county of Yorke, Yeoman do make and ordaine this my last will and as testament in manner and forme following. First I give and bequeath my soule into the hands of almighty God my maker trusting only in Christ’s mercy to be saved. And my bodie to be buried in the parish churchyard of Aldburgh. Item, my mind and will is that my son and heire Peter shall peaceably and quietly enter, enjoy and occupy two farmsteads (whereof one is called the Butcher Close) and all the freehold lands in arable, meadow and pasture lying in the fields of Aldburgh which of right belongs unto him being the right heire of me the forenamed Peter Earle and Ann my former wife (my other freehold lands exempted) Item, I give and bequeath more unto my son Peter to him and his heires for ever my now dwelling house with the outhouses, garths and right of common and all other privileges to which belong to the house (the croft lands only exempted) all which I purchased of Daniell Smithson. Upon condition that my son Peter shall pay to my son Francis, his tutor for his use fortie pounds of lawful English money within one halfe yeare after that my son Peter shall come to the age of one and twentie years. And if he refuse or neglect to pay the forenamed fortie pounds then I give and bequeath my now dwelling house with all rights and privileges belonging (the Croft lands only exempted) to my son Francis to him and his heires forever to enter at the end of halfe a yeare after my son Peter shall come to the age of one and twenty years. Upon condition that my son Francis his tutor shall pay to my youngest daughter Isabelle tutor for her use fifteen pounds of lawful money of England within two yeares, whether he receive the forenamed fortie pounds or enjoy and enter to my house. And if my son Francis shall chance to die before my son Peter shall come to the age of one and twentie and halfe a yeare after this my mind and will is that my son Peter shall pay to the tutor of my three children Matthias, Elizabeth and Mary for their use the forenamed fortie pounds within one halfe yeare after that my son Peter shall come to the age of one and twentie and if he refuse to pay fortie pounds, then I give the forenamed house with all rights belonging (the Croft lands only exempted) to my three children Matthias, Elizabeth and Mary to them and their heires for ever equally to be divided amongst them. And my mind and will further is that although my son Peter hath paid the forenamed fortie pounds either to my son Francis his tutor or to my three childrens tutors. But if he dye without heires of his bodie lawfully begotten then I further give my now dwelling house with all rights belonging (the Croft lands only exempted) to my five youngest children to them and their heires for ever to be divided equally amongst them. And whereas Elizabeth Thompson gave by her last will and testament seventeene pounds unto my daughter Margaret which I received for her use. In confirmation of the seventeene pounds my mind and will is that she shall have thirteene pounds which will make her thirtie pounds. Then I give unto my daughter Margaret ten pounds more out of my household goods to be praised by foure honest men which I give in full satisfaction of her portion. Item, I give and bequeath unto Matthieu my son and Elizabeth and Mary my daughters all my five acres of freehold lands which I purchased to them and their heires forever. Viz. two acres lying in the Lowe Close; one acre in the new intake adjoining to the Low Moore; one rood and a halfe in the west field lying on a flatt called the Berries; three roods in the same fields lying between the lands of Ruth Smithson north and my fielde south; one rood and a halfe in Yorke House fields lying on a flatt called the Low Shorteford the lands of widdow Sutton north and my field south; one halfe acre lying on the curtlidge of my house called the Croft. Item, my mind and will is that my wife Elizabeth shall have the benefits and profits of the forenamed five acres until my children shall come to the age of one and twentie yeares towards their education. Item, I give and bequeath to the trustees of the parish of Aldburgh six shillings and eight pence to be added to the parish stocke. Item, all the rest of my goods moveable and immovable (my debts paid and funerall expenses discharged) I give and bequeath unto Elizabeth my wife, whom I make sole executrix of this my last will and testament and all other former wills I revoke and call in. In testimonie hereof I have sette my hand and seale the day and year first above written, Peter Earle his mark.

THIS WILL was proved at London before the judges for probate of wills and granting administration lawfully authorised the thirtieth day of June in the yeare of our Lord God one thousand six hundred fiftie eight by the oath of Elizabeth Earle, the relict. of the said deceased and sole executrix therein named. To whome administration of all and singular the said deceased goods, chattels and debts was granted and committed she being first sworne by commission hereby to administer.

The condition of this obligation is such that if the within bound Henrye Earle doe well and truly content, satisifye and pay or cause to be well and truely contented, satisfyed and payed unto Anne and Margaret Earle, all and lawfull children of Peter Earle of Minskip late deceased, all such filial childs part and portions and all other rights whatsoever due unto them by the death, will and inventorie of their said deceased father in good and lawfull English money when they shall accomplish their lawfull age of xxj yeares, be married or otherwise lawfully demanding the same. And in the meane time doe well and honestly educate and bringe them up with meate, drinke, cloathing and all other necessatyes duringe their minorotye. And also doe upon lawfull means unto him give, bringe in and deliver into the Registry of Richmond a true and just account of the premisses. The condition of this obligation is such that if the within bound Henry Swale doe and shall well and trulie administer all and singular the goods, rights and creditts w'ch late where and did belong unto John Earle late of South Stainley aforesaid deceased soe farre as lawe shall binde him. Alsoe he doe exhibite unto the Registrye at Richmond a true and perfect inventorie of the goodes of the said deceased. And alsoe paye off the debts of the said deceased soe farre as his the said deceased goods will extend and lawe shall bynde him. And make a true and just account of the premisses when he shalle thereunto lawfullie called. And lastly save and harmlesse keepe the within named Reverend Father in god, and the said Comissarie and allow all other his officers and ministers against all and everie person and persons whatsoever by reson of the premisses. Chapter Note

 

The above Bond relates to John Earle who married Blanch Sympson in Hampsthwaite 1664. Very little is known about this family other than they had two daughters, one of whom was baptised after John died. The absence of a will suggests John died suddenly and at a young age

In the name of god Amen - the twenty second day of June in the yeare of our lord god 1671 - I Richard Earle, the elder, of Roecliffe in the County of Yorke in the parish of Aldborough beeing weake in body butt of p’fect remembrance, thanks to almighty god, and calling to remembrance the uncertainty of this transitory life and that all at laste must yield unto death when itt shall please god for all. I do make, constitute, ordaine and declare this my last will and testament in manner and forme followeing and do acknowledge this to be taken oraly for my last will and testament and not other, and first being penitent and sorry from the bottom of my heart for my sinns past most humbly desiring forgivenesse for the same. I give and comitt my soule to almighty god my saviour and redeemer in whom and by the meritts of Jesus Christ I trust and believe assuredly to be saved and to have full reconciliation and forgiveness of all my sins and that my soule which my body at the general day of resurrection shall rise again with joy and through the meritts of Christs death and passion possesse and inherit the kingdome of heaven prepared for his well and chosen, and my body to be buried in this place within the churchyearde of St Andrew’s in Aldborough in the usual place amongst the parishioners of Roecliffe or where my executor or executors hereafter named shall please to appoint. And for the settling of my temporal estate and my goods, chattels and debts as it hath pleased god faire above my defects to bestowe of me. I doe order, give and dispose the same in manner and forme following (that is to say) first I doe order and appoint that just debts and dues and somes of money as are oweing by me to any person or persons shall be paid in convenient time after my decease out of my goods and chattels. And out of the remainder of my goods and chattels I doe order and appoint my executor hereafter named to pay unto my daughter Ann Earle the sum of twenty pounds of lawful English money when she shall accomplish the age of twenty and one yeares. And for the freeholde land that I have purchased off John Norcrofte and Mary his wife and Isabell Fawcitt, I freely give and bequeath itt to my sonne Richard Earle and his heirs for ever. IN THE NAME OF GOD AMEN the thirtith day of June in the two and thirtith yeare of the Reigne of our Soverign Lord Charles the second by the grace of god, King of England A.D. 1680: I, Peter Earle of Westwick in the Countie of Yorke, yeoman doe in p’fect memorie praised be god make and ordain this my last will and testament followeth. First I recomend my soule to Almightie god my maker through the alsufficient merits of Jesus Christ my redeemer and I comitt my bodie to the earth. ITEM, my desire and will is that my debts shall be honestlie payd to which end I desire that deed of joynture which I have made of part of my lands lyeing in Aldbrough in the aforesaid Countie to the use of me the said Peter Earle and Marye my now wyfe for our naturall lives and after our bereale to the heires of our bodies forever, shall forthwith be cancelled and made voyd to all intents. And after the canceling of the said deed of joynture I doe give and devise to my trustie Brother in law Peter Simpson of Bishop Mounckton in the said Countie, yeoman and Thomas Lawson of Whixlay in the said Countie, yeoman and to their heires for ever – all those eight acres of arrable land and meadow ground lyeing within the territories of Aldbrough aforesaid, viz: in Sower Syke field three roodes lyeing on a place called Moores Briggs between the lands of Richard Fall on the east and of me the said Peter Earle on the west. ITEM, I give the other pte of my said dwelling house with the one halfe of the barne and all such appurttents as if not disposed on as aforesaid with one croft land adjoyning at the end of the said messueage one land in the same feild lyeing for three roodes upon a place called High Briggitts between the lands of me the said Peter Earle on the west and Nicholas Smithson on the east. In Minskip feild three roodes on a place called Nepacarr between the lands of Thomas Sutton on the north and ye lands of me the said Peter Earle on the south. In Yorkeous Feild one acre called Dalla Acre the lands of Peter Burnand on the north and my own lands lyeing on ye south with all and singular thappurttents to Marye my wyfe for her naturall lyfe and after her decease to my sone Peter Earle and to his heires for ever. ITEM, I give to my sone John Earle one close lyeing in Aldbrough being a messueage called Buther Close with thappurttents and alsoe three roodes lyeing in the said Sower Syke feild called Horesbriggs between the lands afore disposed to Peter Simpson and Thomas Dawson on the east and the lands late of Richard Screwton on ye west. To my said sone John and to his heires for ever. ITEM, I give to my three daughters, Elizabeth, Marye and Ann three acres of Meadow ground lyeing in ye Ings of Aldbrough aforesaid, viz: In the Little Ings one acre and in the Long Ings two acres and alsoe two acres and a half of Arrable land lyeing within the feilds of Aldbrough aforesaid, viz: in ye feild between the towne three roodes on ye Briggitts, in the said Minskip feilds three roodes on a place called Neepacarr, in Yorkeous feilds one acre called Dalla Acre and in Sower Syke feilds half an acre on a place called Short Hesle Acres with all and singular thappurttents as the same is bounden that large in the ancient deeds of the same. To my said three daughters and their heires forever to be equallie devided amongst them. Yet my will is that if anie of my said daughters doe dye before they attayn to the age of one and twentie yeares that my sone Peter Earle for his heirs shall have the dead part. In the name of God Amen the seventeenth day of March one thousand six hundred and eighty seaven, I Richard Earle of Minskip in the County of Yorke, Batchelor being infirme of body, but through God's mercy sound of minde and memory doe make this my last will and testament in manner followinge. First I bequeath my soul into the hands of God my maker, redeemer and sanctifier and my body to Christian buriell how, and after what manner my executor hereafter named shall thinke fitt. And as for my temporall estate I thus dispose of it to witt: Imprimis, I give and bequeath unto my deare brother Peter Earle of Grafton and to his heires for ever all my lands in Minskip payinge and discharginge such legacies as are herein mentioned – that is to say I give and bequeath unto the children of Christopher Smyth, my brother-in-law that is to say those two by my sister by name John and Helen one hundred pounds out of my lands and personall estate when and as soon as each of them attaine the age of seventeen years. Item, I give unto John Earle, now my man-servant, five pounds. Then I give unto Christopher Smyth (junior), my godsonne, five pounds to be paid at the age of seventeen yeares. Then I give to Christopher Smyth (senior) of Minskip above said five pounds and alsoe to Helen Smyth, my deare sister, now wife of the said Christopher Smyth five pounds to be paid within a yeare of my decease. Item, I give unto these four hereafter named, that is to say Mr Robert Vintner of Yorke, Mr Paul Stephen of the same, Mr William Hardcastle and Mr William Pearson twenty shillings apiece. Item, I give to two other children of Christopher Smyth aforesaid by name, Thomas Smyth and Richard each of them ten shillings. Lastly my debts, legacies and funerall expenses being discharged I give and bequeath all the residue of my estate moveable and immoveable unto my deare brother Peter Earle of Grafton aforesaid, whom I doe also nominate, make, appoint and constitute sole executor of this my last will and testament in witnesse hereof and in all things herein contained and expressed I have hereunto sett my hand and seal the day and yeare first above written.

The condition of this obligation is such that the above bounden Peter Earle do well and truly execute, perform, fulfil and keep the last will and testament of Richard Earle, late of Minskip within the Archdeaconry of Richmond deeded in keeping all his debts and legacies so far as his goods will extend. And law shall bind him if also he do exhibit into the registry of the said Archdeaconry above a perfect inventory of all the singular goods, rights, credits and chattels which were and did belong unto the said deceased and make a true list of the same when he [blank] shall be lawfully called thereunto and if need require enter into such further bond with more sufficient sureties for performance of the purposes as the commissary of the said Archdeaconry for the time being shall think requisite and needful and lastly do save, defend and harmless keep the above named law. By order of commission aforesaid and all other their offices and ministers against all persons by reason of the premises then this obligation do be void or else to remain in full force and virtue.

In the name of god Amen. I, Peter Earle of Minskip in ye County of Yorke, Yeoman being infirm of body, but of perfect mind & memory thanks be to god do make this my last Will & Testament in manner & form following. First, I bequeath my soul to god & my body to ye earth to be buyed at ye discretion of my executor hereafter named. And as for ye temporal goods wherewith god has blessed me, I give & bequeath ye same as follows. First, I give to my niece Catherine Smith twenty pounds with all ye furniture of my house. Item, I give to John Gifford, John Knaresbrough, Willm Calvert, Michael Metcalf & Ambrose Jackson each twenty shillings. Item, I give to Isabel & Peter Appleyard each thirty shillings. In the name of god Amen the twentieth day of February in the year of our lord god 1718, I Henry Earle of Roucliffe in the county of York, yeoman, being very sick and weak in body, but of perfect mind and memory thanks be to god therefore calling to mind the mortalytye of my body and knowing that it is appointed for all men once to die do make and ordain this my last will and testament, that is to say. First of all I give and recommend my soul into the hands of god that gave it; an for my body I recommend it to the earth: to be buried after a Christian like and decent manner at the discretion of my executors nothing doubting but at the generall resurrection I shall receive again the same by ye mighty power of god and as touching such world by effete whom with it hath pleased god to bless me in this life. I give and dispose of the same in manner and form following. Imprimis, I give and bequeath to Jane my beloved wife one acre of freehold land during her naturall life and from and after her decease; to her heirs of the said Henry Earle or to whom she thinks fit. Item, I give to my daughter Ann the sum of ten pounds. Item, I give to my daughter Jane the sum of ten pounds. Item, I give to my daughter Elizabeth the sum of ten pounds. Item, I give to my daughter Margaret the sum of ten pounds which said sums to be paid out of my personall estate within one year after my decease; and I likewise make and ordain John Earle and Timothy Pullan, my two godsons, trustees for my children. Item, I give to my brethren John and Tho: Earle two shillings and six pence each for a legacy. Item, I give and bequeath to Jane my well beloved wife all my personal effects both real and personal and I do make her my sole executor both of quick and dead and I do likewise ordain this to be my last will and testament in witness hereof I do hereunder set my hand and seal.
