Last Will & Testament (transcript)
William Earl, of Guiseley, Yorkshire.
This is the last Will and Testament of me William Earl of the parish of Guiseley, in the West Riding of the County of York - clothmaker. I, the said William Earl do herby appoint William Riley, clothmaker, John Hudson, clothmaker and my son James Earl, all of Guiseley aforsaid executors and trustees and do hereby invest them with such powers as are to be hereafter mentioned in order that they my said executors and trustees may carry into effect this my last Will and Testament. I, the said William Earl do order and direct that they my said executors shall immediately from the time of my death be possessed of all my real estates consisting of three freehold houses commonly called Club Houses lying and situate in the township of Yeadon in the Parish of Guiseley aforesaid and of two freehold Closes of land lying and situate in the Township and Parish of Guiseley aforesaid called Stockwells and Crooked Lands and the dwelling house and buildings erected thereon also that they shall be possessed of all my household furniture, linen, plate, china and all money or monies that I may have and shall collect and gather in all money or monies that may be owing to me at the time of my death. In Trust for the following purproses viz that they my said executors and trustees shall first pay all my expenses and that they shall invest whatever money may remain in government or landed secutityor securities. I order and direct that they my said executors and trustees shall pay over the rents and interest or interests arising from and growing out of my real and personal property at two half yearly payments to my wife Elizabeth during the term of her natural life for the maintenance of herself and the maintenance and education of my children provided she continue my widow. I order and direct that they my said executors and trustees shall pay out of my personal estate the sum of fifty pounds each to my eldest son James Earl and to my eldest daughter Sarah Child when they shall respectively have attained the age of twenty one years which said sum of fifty pounds to each shall be considered as a part of their share at the general distribution to be hereafter mentioned. But in case if my wife shall marry again I order and direct that they my said excutors and trustees shall pay over to her for her life only such half yearly rents as shall arise from my freehold closes of land and buildings thereon lying and situate in the township and parish of Guiseley afroesaid with the exception of four pounds per annum which said four pounds per annum together with the remaining rents, interest or interests they the said executors shall apply for the benefit of my four younger children, Dorothy, William, Adam and Mary Hannah and others should there by any in such manner as they may deem most advantagious to those said four children and others should there by any. I order and direct my said executors and trustees that at the death of my wife they shall cause to be valued all my real property lying and situate as aforesaid and an account to be taken also of my personal property consisting of furniture, linen, plate, china, money, security or securities for money and a division of my property to be made amongst all my said children so that each child may have an equal share with the exception of my said son James Earl and my said daughter Sarah Child who shall each then receive fifty pounds less than the rest in consideration of the said James Earl and Sarah Child have each received that sum on their attaining respectively the age of twenty one years. But if any of my said children shall die before my wife leaving legitimate issue then the share of that deceased child shall go to the legitimate issue share and share alike if more than one and if any of my said children shall die before my wife leaving no legitimate issue then the share of that deceased child shall be equally divided amongst my living children. I order and direct that my executors and trustees after such valuation be made and account taken of my real and personal property shall make an offer of the two closes of land Stockwells and Crooked Lands together with the house and buildings theron to any of my children according to the said valuation in order that the said two closes, housestead and building thereon remain in the family and in case any of my children shall agree to purchase this said property then my said executors and trustees shall sell only the three said freehold houses lying and situate in Yeadon but provided any child or children shall not be able or not think proper to purchase the said two cloes and buildings thereon then the whole of my real property to be sold my secutires converted into money and the proceeds to be divided amongst my children subject to the provisions before stated. But in case my wife die before my youngest child attain the age of twenty one years then I order and direct my said executors to pay over until that period to my daughter Dorothy now weak and delicate provided her health be such as not to allow her to labour for her own livilihood - the annual sum of twenty pounds in two half yearly payments of ten pounds each and that at the disposal of my property subject to the provisions before stated. I, the said William Earl do hereby revoke all former Wills by me at any time heretofore made and declare this to be my last Will and Testament in witness whereof I set my hand and seal this twenty eighth day of March in the year of Our Lord one thousand, eight hundred and thirty five.

William Earl, of Guiseley, Yorkshire.
I, William Earl of Guiseley in the West Riding of the County of York having made, signed and declared my last Will and Testament bearing date the twenty eighth of March one thousand, eight hundred and thirty five, do hereby make this Codicil confirming and ratifying my said Will and Testament excepting that part which made provision for my daughter, Sarah Child, who is now dead and has left one child which part I do hereby will and bequeath that my said deceased daughter's infrant, David Child, who shall on his attaining the age of twenty one years be entitled to an equal share and share alike, but in case my grandson, David Smith Child, died before attaining the age of twenty one years without having legitimate issue then I do will and declare that the share of the deceased grandchild shall be equally divided amongst the rest of my surviving children or in case of their death amongst their several children respectively and I, the said William Earl do will and delare this Codicil be taken and adjudged as a part and parcel of my last Will and Testament and that all things herein contained be in every respect as faithfully, truly and fully perfored as if the same were set down and declared in my last Will and Testment. In witness whereof, I do hereunto set my hand and seal this second day of September One Thousand, Eight Hundren and Thirty Six.
