Ralph Welford, Yeoman of Brotton, 1798

I, Ralph Welford of Brotton in the County of York, Yeoman do make this my last Will and Testament in manner following, that is to say, I give and bequeath to my dear wife Hannah Welford for and during her natural life, if she shall so long continue sole and unmarried, the annuity or yearly sum of ten pounds to be paid to her on the twelfth day of May, the twelfth day of August, the twenty-second day of November and the thirteenth day of February in every year by equal portion without any deduction or abatement whatsoever. The first payment thereof to be made on such aft the said day as shall first happen after my decease; but if my said wife shall happen to marry again then from and after such her marriage the said annuity shall cease and be no longer paid. I also give and bequeath to the several persons hereinafter named the respective legacies or sums of money hereinafter mentioned, that is to say to my son John Welford the sum of twenty pounds; to my son George Welford the sum of thirty pounds; to my daughter Mary Lyth the sum of thirty pounds; to my daughter Ann Welford the like sum of thirty pounds; to my daughter Hannah Harland the like sum of thirty pounds; to my daughter Frances Harrison the like sum of thirty pounds and to my daughter Martha Scrafton the like sum of thirty pounds. All the said legacies to be paid at the end of one year next after my decease. I also give and bequeath to my grandson William Welford the sum of ten pounds to be paid to him on his attaining the age of twenty one years. I also give to my said wife one feather bed with the bedstead, bedding and furniture thereto belonging and so much and such parts of my household goods as are hereinafter mentioned, that is to say six oak chairs, one oak tea table, six silver tea spoons, six china tea cups, six china saucers, one tea kettle, one warming pan, six delph plaits, six pewter plaits and one delph rack. And to each of my said daughters, Ann Welford and Frances Harrison one feather bed with the bedstead and bedding and furniture thereto belonging. I also give to my son Joseph Welford all my milk vessels and all my carts, carriages, ploughs, harrows and implements of husbandry and husbandry gear whatsoever. And subject to and charged with the payment of my just debts and funeral expenses and the annuity and legacies before mentioned, I give and bequeath all my ready money and securities for money, goods, chattels and personal estate whatsoever and wheresoever (not hereinbefore otherwise given and disposed of) unto my said son Joseph Welford and appoint the said Joseph Welford sole executor of this my Will hereby revoking all former Will and Wills by and made. In witness whereof I have hereunto set my hand and seal the twenty-seventh day of July in the year of our Lord one thousand seven hundred and ninety eight

John Welford - 4th June 1864

This is the last will and testament of me John Welford of Brotton in the County of York, butcher made the fourth day of June in the year of our Lord one thousand eight hundred and sixty four. I give unto my dear wife Eleanor Welford my pair of drawers. I give to Barney Marshall of Brotton aforesaid, agricultural labourer my watch, weather glass, press and wearing apparel. And I give and bequeath all my farming stock, crops, implements of husbandry booked to ready money and all other residue and remainder of my household furniture, personal estate and effects whatsoever and wheresover unto and equally between my said wife, Eleanor Welford and my sister Elizabeth Marshall the wife of Joseph Marshall of Brotton aforesaid equally between them the share of the said Elizabeth Marshall be subject to the payment of the leagacy sum of ten pounds to Mary Hall the wife of William Hall of Whitby in the said County of York, mariner to be paid to her at the end of three calendar months next after my decease to whom I give and bequeath the same. And I do herby direct that the receipt of the said Mary Hall shall notwithstanding her coverture be a good discharge for the said legacy and in case my said wife Eleanor Welford and my said sister Elizabeth marshall cannot agree in dividing my said household furniture and other effects hereinbefore given to them I direct that my executors hereinafter named (with the exception of my named wife) shall apportion and divide the same between them and their decision as to such division shall be conclusive. And I hereby charge and make chargeable my said personal estate with the payment of my just debts, funeral and testamentary expenses (except my mortgage debt with which my real estate hereinafter devised may be charged). I give one moiety or equal half part of and in all those my three messuages or dwelling houses with the outbuildings, garths and premises to the same belonging and also one moiety or equal half part of and in that my butchers shop and stable situate in Brotton aforesaid and of and in all other my real estate unto my said wife Eleanor Welford and her assigns for and during the term of her natural life. And I give and devise the other moiety or equal half part of and in my said three messuages, dwelling houses, butchers shop hereditaments and real estate unto the said Elizabeth Marshall her heirs and assigns for ever and from and after the decease of my said wife Eleanor Welford I give and devise the entirety of my said messuages or dwelling houses, butchers shop and real estate unto the said Elizabeth Marshall her heirs and assigns for ever. And I charge and make chargeable my said real estate with all securities and incumbrances affecting the same at the time of my decease. I give and devise all and every the messuages, tenement lands and hereditaments whereof or wherever I am entitled to any estate of freehold of inheritance by virtue of any mortgage or mortgages unto and to the use of William Young of Brotton aforesaid, farmer, George Welford of Easington in the said County of York, farmer and my said wife Eleanor Welford their heirs and assigns to the end and intent that the same may be reconveyed upon payment of the principal sums and interest thereby secured. And I give and devise all estates vested in me as trustee to the said William Young, George Welford their heirs and assigns upon the trusts and equities affecting the same. And I do hereby declare and direct that the said William Young, George Welford and Eleanor Welford their heirs and assigns shall be allowed all such costs, charges and expenses as he or they shall sustain, expend or be put unto in or about the execution of the trusts hereby in them reposed or anywise relating thereto. And they shall not be answerable or accountable for the acts of the others or other of them notwithstanding they or any of them shall join in any receipt for the sake of conformity and that in the event of any one of them dying another shall be appointed by the survivor or survivors. And I appoint the said William Young, George Welford and Eleanor Welford executors and executrix of this my last will and hereby revoke all former wills by me and made. In witness whereof I have hereunto set my hand and seal the day and year first above written.
