Last Will & Testament

 

Ralph Welford – 10th May 1858

This is the last will and testament of me Ralph Welford of the township of Roxby in the County of York, farmer - in manner and form following. First I direct that all my just debts, funeral and testamentary expenses shall be fully paid and satisfied by my executors hereinafter named as soon as conveniently may be after my decease. And after payment and satisfaction thereof I give and bequeath the following anuity and legacies or sums of money, namely - to my dear wife Hannah Welford an annuity or yearly sum of twenty pounds during her natural life or so long as she continues my widow the said annuity to be paid by my executors hereinafter named on the fifth day of June, the fifth day of September, the fifth day of December and the fifth day of March in every year by even and equal proportions the first payment of the same to begin and be made on such of the said days as shall first happen after my decease. To my daughter Elizabeth the sum of sixty pounds. To my daughters Ann, Martha, Hannah, Jane, Frances, Dorothy and Mary the sum of forty pounds each, the above legacies I direct to be paid by my executors hereinafter named as follows, namely one quarter of the said leagacies, or sums of money at the expiration of a year next after my decease to the several and respective legatees and so on at the expiration of every year until the expiration of four years and in case any or either of them the said Elizabeth, Ann, Martha, Hannah, Jane, Frances, Dorothy and Mary shall happen to die without issue before her or their legacy or legacies becomes payable then I give the share of her or them dying unto the survivors or survivor of them. I give and bequeath all my stock, crops and implements of husbandry and all other my personal estate and effects whatsoever and wheresoever to my son Joseph Welford, George Welford, John Peirson Welford and Ralph Welford their executors, administrators and assigns for them and their own use and benefit absolutely. And I nominate, constitute and appoint my said sons Joseph Welford, George Welford, John Peirson Welford and Ralph Welford executors of this my will hereby revoking all former and other wills by me at anytime heretofore made and do declare this to be my last will and testament. In witness whereof, I the said Ralph Welford the testator have to this my last will and testament set and subscribed my hand the tenth day of May in the year of our Lord one thousand eight hundred and fifty eight

Mr Ralph Welford died aged 56 on 11th June 1858 at Roxby. He was an extensive farmer, grazier and butcher - highly respected by a large circle of friends

On 20th day of December 1858 the will of Ralph Welford late of Roxby in the County of York, farmer - deceased who died on the 11th day of June 1858 at Roxby aforesaid was proved in the District Registry attached to Her Majesty's Court of Probate at York, by the oath of Joseph Welford of Roxby aforesaid, farmer the son of the said deceased, one of the executors therein named having first been sworn duly to administer (power being reserved of making the like grant of Probate to George Welford, John Peirson Welford and Ralph Welford the sons of the said deceased and the other executors named in the said will when they shall apply for the same
