Note
This section begins with an entry found in the Register of the Freemen of the City of York. The register, generally known as the 'Freemen's Roll,' is supposed to contain the names of all persons who took up the freedom of the city during the period between 1271 and 1671
Freedom of the City was obtained in three different ways. First, by servitude; that is, the applicant must have served his full time as an apprentice before his enrolment; secondly, by patrimony; that is, the children of a freeman can claim their freedom as their heritage; thirdly, by redemption; that is, by order of the Mayor and Court of Aldermen, which means that the recipient obtained it either by purchase or that it was given to him, without payment, as a reward for some more or less important services rendered to the city. The fees varied from time to time; in the earliest chamberlains' account-books the charge for those who had served their apprenticeship seems to have been either 3s. 4d. or 6s. 8d., but there are cases where only 20d. was paid.

Precis of the case...
It was alleged Robert Erle said to John Bell, "Brother, I have been to seek you at your house, and there I found a priest sitting with your wife, and if you knew so much about him as I hear say, you would not trust him." And when John Bell asked why, Robert Erle answered saying "that he heard one or two say that Sir William Bell (the priest) had been about the mason's lodge within the Minster precincts on last All Hallows night with a wench, and that he was taken so hastily that he did not manage to tie up his codpiece."

In The Name of God Amen I, George Earle of the City of York, Gardener being weak in body, but of sound mind and memory blessed be God - do this 26 Day of November in the eighteenth of the reign of the Lord George the third King of Great Britain, France and Ireland defender of the faith and so forth and in the year of our Lord 1777 make and publish this my last will and testament in manner and form following. That is to say, first I commend my Soul into the hands of God who gave it out and my body to the earth from where it rest in hopes of a joyful resurrection through the merits of my Saviour Jesus Christ. And as for worldly estate wherewith it hath pleased God to bless me with I will leave in the following manner. First all my just debts be paid and my funeral expenses. In the first place I will give unto my loving wife the interest of £700 stock that I have in the South Sea Annuities she shall have full power to receive it every half year as it becomes due. I will give unto my dear wife the interest of all moneys that I have in other securities, all which she knows so shall not mention them, if any of them moneys be paid in it shall be lawful for my wife to receive it and to put it out in the best manner she can for or own use. I will give unto my dear wife the house that I now live in, but not the garden that I shall dispose another way, but she shall have all priveledge to go in the garden to dry her cloathes or any other occaision. I will give unto my dear wife all my furniture that I have in the house, my linnen and plate, but it shall be that my wife keep my widow. But if she play the fool and marry again then it shall be lawful for my son, George to take from his mother all the moneys that I have so generously given her. I charge my son that if he knows that his mother goes to be married to any other man that he shut the door against his mother and permit her no more to enter, but I have hopes that she will not play the fool so shall say no more about it. I will in the next place. I give to my son George Earle all my houses and gardens, but the house that I live in that I have given to my wife during her life, but he to have all my houses, gardens etc for him to enjoy to him and his heirs for ever all my moneys etc that I have shall count to my son George Earle after his mother decease. This is the only will that I have ever made which I make with my own hand that no disputes may be when I have gone. Memorial Inscription
Here lyeth the body of George Earle who departed this life December 10th 1777 aged 58 (see 1800 below)
On this day appeared personally, John Belt of the City of York, surgeon and Ann Buckle of the said City, widow and being severally sworn on the Holy Evangelists to depose the truth deposed as follows. That they, these deponents well knew and were intimately acquainted with George Earle late of the City of York aforesaid deceased for several years before and to the time of his death during which time thay have often seen him write and subscribe his mark and are thereby well aquainted with his manner and character of handwriting and subscription and having now seen and carefully viewed the paper writing hereunto annexed purporting to be the last will and testament of the said deceased beginning thus "In the name of God Amen, I George Earle of the City of York - gardener being weak in body but sound of mind and memory" and ending thus "I ordayne my son George Earle to be the Executory of this my will which I have signed with my own hand" and subscribed "George Earle" they these deponents do verily believe the aforesaid writing beginning, ending and subscription to be the said will in manner as therein now appear to be all of the proper handwriting of the said deceased. John Belt & Anna Buckle the day aforesaid were severally sworn to the truth of this affidavit before me. L Place - surrogate in the presence of me, John Browne - notary public.
This will was proved at London the third day of March in the year of our Lord one thousand seven hundred and seventy eight before the Right Worshipful Sir George Day, knight, doctor of law, master keeper accounts of the prerogative court of Cantebury lawfully constituted by the oath of George Earle, the son of the deceased and sole executor named in the said will to whom administration was granted, of all and singular the goods, chattels and dredits of the said deceased having been first sworn by commission duly to administer.

Thomas Calvert of the City of York, gentleman maketh oath and saith that by Articles of Agreement bearing date the twenty second day of July instant and made between William Earle of Mount Parade in the suburbs of the City of York, gentleman and George Earle of the same place, the son of the said William Earle of the one part and John Brook of the City of York, gentleman (one of the attornies of his Majesty's Court of King's Bench at Westminster) of the other part the said George Earle for the consideration therein mentioned did put and place himself Clerk to the said John Brook to serve him in the profession of an attorney at law from the day of the date of the said Articles for the term of five years thence next ensuing and fully to be complete and ended and which said Articles were in due form of law executed by the said William Earle, George Earle and John Brook in the presence of this deponant and one James Grayston of the said City of York, gentleman and that the names "Thos. Calvert" and "James Grayston" set and subscribed to the said Articles as witnesses to the due execution are the proper hand writing of this deponant and of the said James Grayston

A Murderous Assault
Late at the night on Thursday 20th December 1877 farm labourer James Howland was disturbed by a commotion near his cottage on West Lane, Stillington. On investigation he discovered Police Constable Bell of the North Riding Constabulary lying at the side of the road covered in blood and in a semi-conscious state. He helped the constable into his cottage and did what he could.
Help Arrives
Assistance was sent for and shortly after midnight arrived in the form of Inspector Ellerby and a doctor, who after examining the PC pronounced a deep head wound, some three inches in length and extending into the bone, to be very serious and that he shouldn’t be moved. A few hours later PC Bell’s condition worsened and it seemed wise to take a statement from him.
The Murderous Assault
On Thursday 20th December PC Bell was on duty, patrolling the high road between Stillington and Sutton on the Forest, when he heard someone chopping in a field near Stillington which was owned by Mr Ralph Appleby of Moxby. Knowing there was a large holly tree in that field he waited a short while and a man appeared on the road leading a dun coloured pony pulling a cart: the cart was piled high with holly. This man was George Marshall Earle, a 41 year old gardener’s labourer from Bramley near Leeds, but a native of York. PC Bell charged him with stealing the holly, at which time Earle said he didn't realise he was doing anything wrong. He said he would come quietly, hoping he might be let off, so PC Bell didn't handcuff him. Leading the pony the PC started to take his prisoner to Easingwold.
At some point during the journey Earle suddenly produced a bill hook he had kept hidden and threatened PC Bell, then suddenly struck him through his cap, cutting his head. A scuffle broke out between the men during which Bell was cut further as he tried desperately to handcuff Earle. The men rolled into a ditch, at which time the PC, weakening from loss of blood and unable to manage his prisoner, broke away from Earle who chased him. Finally coming in sight of a house Earle took fright and ran away, leaving PC Bell to be found by Mr Howland.
The Arrest
Earle was captured the following day at a public house in Cattall by PC Ambler of Shipton, after he had been spotted on the road between Alne and Youlton and later crossing Aldwark Bridge. When questioned by PC Ambler he denied knowing anything about the assault on PC Bell. He still had the pony and cart, but had dumped the holly, which was the cause of so much trouble, on the road. However when he was examined there were signs that he had been in a fight and marks on his jacket cuff were consistent with an attempt to fasten handcuffs. PC Ambler then charged him with the assault on PC Bell.
Before the Bench
Earle was taken to Easingwold where he appeared before the special court of the petty sessions held in the Magistrates Clerk’s office. After a short trial in which evidence was given that he had told the toll keeper at Wigginton he was going to cut holly at Stillington he was sentenced to a month in gaol for damaging Mr Appleby's shrubs . Having served that sentence he was sent for trial at Leed's Assizes . There on the 17th January 1878 he found guilty of assaulting PC Bell with intent to murder and was sentenced to ten years penal servitude. He was sent to Dartmoor Prison (see 1881 census entry below). PC Bell, nearly recovered from his wounds, was awarded £10 in recognition of his bravery.
The Aftermath
This case made the police nervous and any hint of an assault on a member of the North Riding Constabulary was retaliated against with sure and swift punishment.
